Mechanics Lien Law - Study H-820

    In 2008, the Commission recommended a general recodification of the mechanics lien law with the objective of modernizing, simplifying, and clarifying the law, and making it more user friendly, efficient, and effective for all stakeholders. That recommendation has been enacted. See 2010 Cal. Stat. ch. 697 (SB 189 (Lowenthal)).
    Some further statutory clean-up was recommended to address chaptering out problems and various other matters relating to the recodification legislation. The Commission approved a final recommendation on the clean-up matters, which was enacted into law. See 2011 Cal. Stat. ch. 44.
    In an earlier phase of this study, the Commission made a recommendation to address the double liability problem in home improvement contracts. That recommendation was not enacted into law.
