Statute of Limitations for Legal Malpractice

    The Commission undertook a study of the statute of limitations for legal malpractice (Code Civ. Proc. § 340.6). The Commission issued a tentative recommendation and a revised tentative recommendation. The Commission also investigated concerns regarding extended exposure to claims of estate planning malpractice and difficulty obtaining affordable malpractice insurance.
    In light of comments received from interested individuals and organizations, in June 2006 the Commission decided to discontinue work on this study. The Commission might reactivate the study in the future if circumstances change and it appears that such work would be productive.
