Revision of No Contest Clause Statute

    Pursuant to SCR 42 (Campbell) of the 2005 legislative session, the Commission conducted a comprehensive study of the state's no contest clause statute and recommended a number of improvements to that statute.
    The Commission's recommendation on this matter was enacted into law in 2008. See 2008 Cal. Stat. ch. 174; SB 1264 (Harman).
    The Commission has also recommended a small number of technical changes to correct cross-references that were made obsolete by SB 1264. Those corrections would be implemented by legislation introduced in 2009. See SB 105 (Harman).
