Award of Costs and Contractual Attorney's Fees to Prevailing Party

    The Commission is studying the standards for determining the prevailing party for purposes of (1) awarding costs, (2) awarding contractual attorney's fees on a contract claim, and (3) awarding contractual attorney's fees on a noncontract claim. The Commission has considered a number of issues and drafts and explored some related topics, but has not yet issued a tentative recommendation. This study is on hold pending completion of higher priority matters.
