Stay of Mechanic's Lien Enforcement Pending Arbitration

    Code of Civil Procedure Section 1281.5 relates to preservation of arbitration rights during mechanic's lien enforcement proceedings. In 2000, the Commission approved a recommendation proposing to amend this provision to simplify the procedure for preserving arbitration rights and obtaining a stay pending arbitration. In 2002, the Commission approved a revised recommendation proposing a different amendment of the provision. A bill to implement the revised recommendation was introduced in 2003, but was amended in the legislative process to implement the original recommendation instead. The bill was enacted.
