Unincorporated Associations - Study B-501

    The Commission is charged with determining whether the Uniform Unincorporated Nonprofit Association Act should be adopted in California, either in whole or in part. The Commission has decided to recommend the reorganization and improvement of existing unincorporated association law, rather than adoption of the Uniform Act.
    The Commission has completed a general recommendation on unincorporated associations (addressing such matters as property ownership and member liability). Implementing legislation will be introduced in 2004. The Commission is currently preparing to distribute a tentative recommendation on selected issues relating to unincorporated association governance (e.g., amendment of governing documents, merger, dissolution).
