Appellate and Writ Review Under Trial Court Unification - Study J-1310

    As a result of unification of the superior and municipal courts, each superior court's appellate division reviews appeals and writs taken from its own court. This type of peer review creates at least an appearance of impropriety. The Commission has circulated a tentative recommendation to create a limited jurisdiction division within each court of appeal district, replacing the individual superior court appellate divisions.
    The Commission has discontinued further work on this project due to state budgetary constraints on court operations. The Commission may reactivate this study in the future, as circumstances warrant.
